1 Acceptance of the General Terms and Conditions of Sale

1.1 The contract between OLOS Srl and the customer is considered concluded with the acceptance, even partial, of the order by OLOS Srl. Such acceptance is deemed tacit. By placing an order in the various ways provided, the customer declares to have read all the information provided during the purchase procedure and to accept in full the general terms and conditions and payment terms transcribed below.

1.2 The Customer or consumer, once the online purchase procedure is completed, will print or save an electronic copy and in any case keep these general terms and conditions of sale, in compliance with the provisions of Articles 3 and 4 of Legislative Decree 185/1999 on distance sales.

1.3 Any right of the Customer to compensation for damages or indemnity, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or property, caused by the non-acceptance, even partial, of an order, is excluded.


2 Purchase Methods

2.1 The Customer can purchase only the products present in OLOS Srl's electronic catalog at the time of placing the order and viewable online at the web address www.sweetbeleaf.com.

2.2 The correct receipt of the order is confirmed by OLOS Srl via an email reply, sent to the email address provided by the Customer. This confirmation message will include the Date and Time of execution of the order and an 'Order Number', to be used in any further communication with the OLOS Srl staff. The message will reiterate all the data entered by the Customer, who undertakes to verify its correctness and promptly communicate any corrections, following the methods described in this document.

2.3 In case of non-acceptance of the order, the OLOS Srl staff guarantees timely communication to the Customer.


3 Prices

All prices indicated to the end user on www.sweetbeleaf.com are VAT INCLUDED (22%). Product prices may vary without notice.
Delivery costs, indicated separately in the order form, must be added to the price of the Products.


4 Images

The images accompanying the descriptive sheet of a product are for illustrative purposes only to allow the best perception of the product. The images of the advertised products may not be perfectly representative of their characteristics but differ in color, size, accessories shown in the figure.

5 Payment Methods

5.1 Credit Card

In cases of purchasing goods with Visa and Mastercard credit card payment methods, Maestro-enabled debit cards, at the same time as the online transaction, the reference bank will authorize only the commitment of the amount related to the purchase made. The amount related to the goods dispatched, even partially, will actually be charged to the Customer's credit card only when the goods are dispatched from our warehouse. In case of order cancellation, either by the Customer or in case of non-acceptance by OLOS Srl, our staff will promptly request the cancellation of the transaction and the release of the committed amount. The release times, depend exclusively on the banking system and can reach their natural expiration (24 days from the date of authorization). Once the transaction has been canceled, OLOS Srl cannot be held responsible in any way for any damages, direct or indirect, caused by delay in the release of the committed amount by the banking system. If the Customer's order is processed beyond the 23rd day from the date of submission, OLOS Srl will still proceed with the debit on the Customer's credit card of the amount due, even if in advance of the actual delivery of the goods, to avoid the expiration of the transaction authorization (24 days). OLOS Srl reserves the right to request additional information from the Customer (e.g., landline number) or the sending of copies of documents proving the ownership of the card used. In the absence of the required documentation, our staff reserves the right not to accept the order. At no time during the purchase process does OLOS Srl have access to the buyer's credit card information, which is transmitted via a secure connection directly to the bank website that handles the transaction. No computer archive of OLOS Srl will store such data. In no event shall OLOS Srl be held liable for any fraudulent or improper use of credit cards by third parties when paying for products purchased on www.sweetbeleaf.com.

5.2 Paypal

In cases of purchasing goods with PayPal payment methods, PayPal will immediately debit the amount related to the purchase made upon the conclusion of the online transaction.

6 Shipping Methods, Delivery Costs, and Customer Care Reports

6.1 OLOS Srl can accept orders only with delivery within the Italian territory and in the countries of the European Union.

6.2 Each shipped order is accompanied by a detailed Transport Document as required by D.P.R. 21 December 1996 n. 696. The invoice is issued only if requested at the time of ordering by indicating the VAT number in the appropriate field. The document can be downloaded from the specific section within your account on the www.sweetbeleaf.com website.

NB: It is not possible to request the invoicing of a previously dispatched order.

6.3 Delivery costs are borne by the Customer and are clearly indicated at the time of placing the order. The payment of the goods by the Customer will be made using the method chosen when placing the order. Nothing more is due by the Customer than the total order amount shown at the end of the purchase process.

6.4 No responsibility can be attributed to OLOS Srl in case of delay in the execution of the order or the delivery of what was ordered.

6.5 At the time of delivery of the goods by the courier, the Customer is required to check that the packaging is intact, not damaged, wet, or otherwise altered, even in the closing materials (adhesive tape or strap). Any damage must be immediately reported to the courier making the delivery. Once the courier's document is signed, the Customer can no longer make any objections about the external characteristics of what was delivered.

Any problems concerning the physical integrity, correspondence, or completeness of the received products must be reported to customer care within and NO LATER than 15 days from delivery.

6.6 In case of non-collection within 5 working days of the material present in stock at the courier's warehouses due to repeated inability to deliver to the address indicated by the Customer at the time of the order, the order will be automatically canceled.

7 Product Availability

On www.sweetbeleaf.com, only products physically available in stock can be ordered. The integrated functionality of item availability in stock is precise; however, there may be slight delays in communication between the actual stock availability and the situation reported on the site. Consequently, the availability of the item in some rare cases cannot be guaranteed with certainty. If one or more ordered items are not immediately available for shipment, our staff will choose to proceed with one of the following solutions based on the order's consistency and the expected restocking times:

- immediately dispatch the available material and send the missing products as soon as they become available without any additional shipping charges;

- contact the customer to choose whether to receive the material in a single shipment, delaying the order dispatch, or to remove the immediately unavailable products from the order.

8 Right of Withdrawal

8.1 If the customer is a consumer (i.e., a natural person who purchases the goods for purposes not related to their professional activity, or who does not make the purchase indicating a VAT reference in the order form to OLOS Srl), they have the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, subject to the conditions indicated in the following point 8.3.

8.2 To exercise this right, the Customer must send a communication to OLOS Srl to that effect, within 14 working days from the date of receipt of the goods. This communication must be sent by email, addressed to info@sweetbeleaf.com, to the attention of:

8.3. The right of withdrawal is subject to the following conditions:

- the right applies to the purchased product in its entirety;

- it is not possible to exercise withdrawal only on part of the purchased product;

- the purchased item must be intact and returned in its original packaging, complete in all its parts;

- by law, the shipping costs related to the return of the item are borne by the customer;

- the shipment, until receipt in our warehouse, is under the complete responsibility of the customer;

- in case of damage to the item during transport, OLOS srl will notify the customer of the incident (within 5 days of receiving the item in its warehouses) to allow them to promptly file a claim against the chosen courier and obtain a refund of the item's value (if insured); in this eventuality, the product will be made available to the customer for its return, simultaneously canceling the withdrawal request;

- OLOS srl is not responsible in any way for damages or theft/loss of goods returned with uninsured shipments; upon arrival in the warehouse, the product will be examined to assess any damages or tampering not caused by transport. If the returned product is found to be damaged, OLOS srl will withhold a percentage from the refund due as a contribution to the restoration costs.

8.4 Without prejudice to any restoration costs for verified damage to the original packaging, OLOS srl will refund the customer the full amount of the goods already paid (excluding shipping costs) by bank transfer or PayPal within 14 days of the return of the goods. It will be the customer's responsibility to promptly provide the bank details on which to obtain the refund (account holder's name, IBAN code).

8.5 The right of withdrawal is totally forfeited, due to the lack of the essential condition of integrity of the item (packaging and/or its contents), in cases where OLOS srl ascertains:

- the absence of integral elements of the product;

- damage to the product for reasons other than its transport.

In case of forfeiture of the right of withdrawal, OLOS srl will return the purchased item to the sender, charging the shipping costs to them.

9 Warranties

The products purchased on www.sweetbeleaf.com are subject to the discipline, as applicable, of Legislative Decree 2.2.2002 n. 24 (G.U. n. 57, 8.3.2002) on sales contracts and guarantees concerning consumer goods and, where not covered, the specific provisions provided for in the Civil Code.

This warranty will apply to the product that presents conformity defects and/or malfunctions not detectable at the time of purchase, provided that the product itself is used correctly and with due diligence, i.e., in respect of its destination and the provisions of any technical documentation, with compliance with the various operating rules indicated therein.

This warranty will not apply in case of negligence, carelessness in the use and maintenance of the product, improper use. The warranty is personal and will therefore apply only to the original purchaser, being reserved for direct customers and not traders, resellers, etc.

Any packaging anomalies of the products must be reported within 15 days of receipt of the goods. The written report must be attached by the customer at the time of returning the defective product.

The product, although defective, to be subject to replacement must, at the time of return to OLOS Srl, be complete with packaging and all accessories and documentation received by the customer at the time of purchase. Returning the product without the original packaging, accessories, and documentation mentioned above prevents OLOS Srl from replacing the product with the manufacturer and makes replacement impossible.

OLOS Srl reserves the right to verify the actual defect claimed by the customer and to carry out the replacement only after such verification. The request will be processed only if the returned package contains the following documents: a copy of the purchase invoice or receipt of the cash on delivery payment, order number and date, a brief description of the detected defect. The return shipping costs to the sender remain at the Customer's expense.

12.2 For any problems or anomalies encountered, before filing a complaint, the Customer is invited to contact the OLOS srl staff through the appropriate section on the website. In almost all cases, any problems or misunderstandings are resolved within a few hours.

13 Applicable Law

The sales contract between the Customer and OLOS Srl S.r.l. is understood to be concluded in Italy and governed by Italian Law. For the resolution of civil and criminal disputes arising from the conclusion of this distance sales contract, the territorial jurisdiction is exclusively that of the Court of Parma.
